Rep. Andy Biggs, R-Ariz., said Tuesday that he’s not surprised at the rancorous divide within the Republican Party over the constitutionality of reversing the Electoral College vote that determined Joe Biden was the winner of the presidential election.
In an interview with Newsmax TV’s “National Report,” Biggs said he disagrees with GOP Arkansas Sen. Tom Cotton’s constitutional objections to such a move.
Cotton has declared that “under the Constitution and federal law, Congress's power is limited to counting electoral votes submitted by the states,” and that should Congress do so, it would “take away the power to choose the president from the people, which would essentially end presidential elections and place that power in the hands of whichever party controls Congress.”
Biggs said he believes Cotton is wrong.
“To be frank, I did anticipate this divide would take place,” he said, adding the Constitution is “the most important institution.”
“I think sometimes folks overthink this,” he said, insisting “the Constitution allows for this process, almost demands we make our case and try to make sure we preserve an election process that is honest and fair.”
Biggs suggested, however, he doesn’t expect Vice President Mike Pence on his own to name different electors at a joint session of Congress Wednesday.
“He’s going to count the electoral votes,” Biggs said, and “when objections are made, my guess is that he’s going to find those objections are in order” and the session will be recessed so each chamber will go and “have our debates and votes on whether you seat those electors.”
Biggs said it’s still unclear if Senators from six states that have been contested by the Trump campaign will join a challenge of the Electoral College votes.
“We’ve been working with Senators,” he said, adding: “I feel very certain if you don’t get all six, you’ll get a majority of those states still being debated.”
He also said he thinks one or both Senators from Arizona could be among the challengers, but noted: “It’s up to those Senators.”
