Betsy McCaughey: Obamacare Ruling Means 'More Pain Ahead'

Former New York Lt. Gov. Betsy McCaughey tells Newsmax TV that Americans who get health insurance through their employers are in for a shock now that the U.S. Supreme Court has ruled to preserve the Affordable Care Act.

"There's much more pain ahead because of Obamacare. For example, the Cadillac tax … a 40 percent tax on generous health plans. It is going to hit almost everybody who gets their coverage through an employer," McCaughey said Thursday on "The Steve Malzberg Show."

"Already, employers are planning on how they're going to cut back on your health benefits to avoid this tax. So that's going to clobber you after the 2016 election and that's by design.

"The worst pain from this law is designed to hit you after the 2016 election when the president is long gone."

The high court ruled 6-3 to preserve that the Affordable Care Act's federal tax subsidies are valid in all 50 states, not just 13 states that set up their own exchanges and three with state-federal hybrid exchanges. A lawsuit had claimed four words in the healthcare law — "established by the state" — meant subsidies were only valid in those 16 states. GOP lawmakers, who declined to set up exchanges in their states, had hoped the court would side with the suit, in effect, killing the law.

McCaughey, a senior fellow at The London Center for Policy Research, made her remarks as she appeared on "The Malzberg Panel" along with New York City criminal defense attorney Adam Thompson.

"I'm not surprised by [the court's decision] at all. They ruled in the past in favor of Obamacare, so you had them slanting in that direction the entire time," Thompson said.

"There was that little clause that said they were leaving it to the states and they might have played with the interpretation of that. [But] they went for the bigger picture, which was when Congress passed this act, Congress really meant to apply it to everyone around the country.

"Politics does enter into this. Everybody knows that. But in the big picture … they're saying that this is really what the mandate was, what the country wanted, that it was intended to apply to everyone and a little nuance of one sentence isn't going to change that."
