Warren: Congress Should Pass Law to Ensure Presidents Can Be Indicted

Sen. Elizabeth Warren, D-Mass, called on Congress Friday to pass legislation to “make it clear” in the future that sitting presidents can be indicted for alleged crimes.

The Democratic presidential contender also said if elected she’ll also push for changes to obstruction of justice laws to explicitly allow for an indictment if a president abuses his powers.

“Congress should make it clear that presidents can be indicted for criminal activity, including obstruction of justice,” Warren wrote in a posting on Medium.

“And when I’m president, I’ll appoint Justice Department officials who will reverse flawed policies so no president is shielded from criminal accountability.”

Her stance comes in the wake of special counsel Robert Mueller’s citation of a Justice Department policy that prohibited him from considering pursing criminal charges against President Donald Trump.

In addition to legislation, Warren said if elected she’d make sure the assistant attorney general appointed to head the Department of Justice’s Office of Legal Counsel will reverse the Watergate-era opinion that says a sitting president can’t be indicted.

“No matter what he may think, Donald Trump is not a King. No President is,” Warren wrote. “And our democracy only works if everyone can be held accountable. These changes will make sure that’s the case for generations to come.”
