A right-to-live lawsuit was filed in Louisiana on Tuesday on behalf of the fertilized eggs belonging to actress Sofia Vergara, Emily Smith of the New York Post reported.

The lawsuit comes amid a nasty legal battle with former fiancée Nick Loeb, who has already sued the "Modern Family" star in California for custody of the embryos, the Post reported. The couple created the embryos in 2013.

Vergara has since married actor Joe Manganiello in 2015.

The female embryos are listed as plaintiffs "Emma" and "Isabella," the Post reported.

The lawsuit contends that the embryos are being deprived of a trust set up for them in Louisiana, and that Loeb should get custody of them so that they can benefit from the trust, the Post reported.
