The Trump administration's attempt to cut off federal funding to sanctuary cities will fail in court, at least initially, Fox News judicial analyst Andrew Napolitano said Monday.
That is because the money currently allocated for cities was approved during the Obama administration and came with no strings attached, Napolitano said Monday on Fox News' "America's Newsroom."
Chicago Mayor Rahm Emanuel announced Monday his city is suing over the order announced last month by Attorney General Jeff Sessions that funds will be withheld from cities, such as Chicago, who refuse to give federal immigration officials notice before they release illegal immigrants from police custody.
But, Napolitano said, Sessions is "trying to add a string after Congress gave the money out," and for that, "the courts will stop him."
That said, when the next budget is passed by a Republican Congress and signed by Trump, such strings can be attached.
Emanuel and other mayors of sanctuary cities "will be in a bind when the money starts coming after October, which will be part of the Trump budget with those strings attached. . . . You accept cash from the federal government, and it's got strings attached, you have to comply with the strings."
