Michael Mukasey: Watch Out for Kerry 'Side Deal' with Iran

By    |   Thursday, 26 March 2015 07:22 PM EDT

Secretary of State John Kerry might be making a "side deal" with Iran over its nuclear program, former U.S. Attorney General Michael Mukasey told Fox News.

"John Kerry has a history of concluding agreements with side agreements, with letters, that you don't find out about months or possibly years later," Mukasey said Thursday on Fox News Channel's "Your World with Neil Cavuto."

Cavuto had asked Mukasey what frightens him most about the current talks. The former attorney general also mentioned President Barack Obama's attempt to avoid Senate approval of a deal.

"The law is that treaties have to be approved by a two-thirds vote, not just a majority, but a two-thirds vote of the U.S. Senate," Mukasey said, but added that the administration has taken the position that the deal is an executive agreement and doesn't need such approval.

"We're talking about sheer, raw power," he said. "They will do everything the executive can do without getting those sanctions that were imposed by statute, by Congress, and can be lifted only by Congress.

The deadline for an agreement is March 31, but Mukasey said the Iranians may actually not even care about a deal.

"They may very well see their best option as pushing the United States as far as they can, get what the United States is willing to agree to out in the open and then not have an agreement and simply go on their merry way," he said. "In essence, pocketing the public disclosure of the concessions, and then wait for things to develop."
