Democratic candidate for president Martin O'Malley said Friday it's "unconstitutional" not to issue birth certificates to children born in the United States to illegal immigrants.

The former Maryland governor took to Twitter to react to a case involving the Texas Department of State Health Services, which is being sued by a group of illegal immigrants for not giving their children birth certificates.

The group's argument seems to have the backing of the 14th Amendment, which states:

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

O'Malley said Texas' refusal to provide birth certificates is "outrageous."


The aforementioned case, according to CBS News, stems from the fact that many illegal immigrants do not have a legal form of identification. Texas law states that birth certificates must be obtained at a local or state registrars instead of hospitals. If the parents of the child do not have a valid form of ID, the application is denied.

Texas Department of State Health Services spokesman Chris Van Deusen said the issue comes down to protecting people's identities.

"You don't want just anybody to represent themselves as a family member and get somebody else's birth certificate," Van Deusen told CBS.

A group of 17 families filed a lawsuit in May, which states, "As a result of this situation, hundreds, and possibly thousands, of parents from Mexico and Central America have been recently denied birth certificates for their Texas-born children."
