Bernie Kerik to Newsmax TV: NJ Gun Law Punishes Law Abiding

Now that the grace period for a New Jersey ban on having a magazine with a capacity of more than 10 rounds has passed, anybody in the state in possession of one, including an off-duty police officer with his own weapon, is in violation of the law, former New York Police commissioner Bernie Kerik told Newsmax TV on Wednesday.

The violation for being in possession of such a banned magazine is a felony, with punishment including up to 18 months in jail and up to $10,000 in fines, or both.

Although Kerik told "The Brett Winterble Show" that New Jersey is in the process of changing the law so off-duty officers can be in possession of the banned magazines, as of now that change has not been signed into law.

Even when it is, he stressed, the problem still remains for all the other law-abiding gun owners who have such banned magazines.

The criminals will pay no attention to the legislation, so any law-abiding gun owner will be face a disadvantage if he needs to defend himself against any of the assortment of bad guys with such magazines.
