Lawsuit: Trump Violated Constitution by Undermining Obamacare

Four cities filed a lawsuit against President Donald Trump, accusing the president of violating the Constitution through his repeated attempts to undermine the Affordable Care Act, NBC News is reporting.

Specifically, NBC reports that the lawsuit contends that Trump is violating Article II of the Constitution: "take care that the laws be faithfully executed."

NBC obtained a draft of the lawsuit filed in Maryland federal court by Chicago, Baltimore, Columbus and Cincinnati.

"There’s a clear case of premeditated destruction of the Affordable Care Act," NBC quoted Columbus city attorney Zach Klein.

The lawsuit will use Trump's own messaging - tweets, public remarks et al - to let Obamacare fail and implode on itself since Congress' failure to repeal the healthcare law last year.

“That’s what makes this case novel, first of its kind and really important,” Abbe Gluck, a Yale University law professor and expert on Article II, told NBC.

"No scholar or court has ever said the president can use his discretion to implement a statute to purposely destroy it," Gluck told NBC News. “If there’s ever going to be a violation of the 'take care' clause, this is it."
