Oklahoma Gun Laws: Can Towns and Cities Make Local Rules?

Gun laws across the country vary greatly from state to state. What may be lawful in Oklahoma may be unlawful in another state. Anytime a citizen goes outside his or her residential state, they would need to ensure they are familiar with that particular state's gun laws.

Some laws that may be different from state to state include, but are not limited to, the allowance of open versus concealed carry, the recognition of a concealed handgun license or permit, specific prohibited carry locations, how to carry in a vehicle, and definitions regarding the term "concealed" and "loaded" or "unloaded."

Due to the complex nature of the laws from state-to-state, when towns and cities make local rulings in regards to gun laws, it can get even more confusing to have separate laws within one state.

In Oklahoma, state law preempts any legislation regarding firearms, components, ammunition, and supplies by any town or city of the state. However, a town or city can adopt any ordinance relating to the discharge of handguns as well as being able to issue citations for transporting a handgun improperly.

They cannot, however, regulate keeping, possession, carrying, bearing, transportation, or any other controls of firearms, accessories, or ammunition. If this section is violated, the person has a right to bring civil action against any persons, municipality, and subdivision for relief, including monetary damages.

However, a property owner, or business entity, may prohibit any person from carrying a concealed or unconcealed handgun on the property. If the building or property is open to the public, signs must be posted on or about the property stating the prohibition.

Although, "No Firearm" signs are not enforceable under Oklahoma state law, when asked to leave, a person must leave.

Due to the Parking Lot Storage Law in Oklahoma, no person, property owner, or business owner can prohibit any person, with the exception of convicted felons, from storing handguns or ammunition in a locked motor vehicle.
