Nevada Abortion Laws and How They Compare Nationally

Though more restrictions have caused abortion clinics to close in different parts of the country, Nevada’s mild regulations have allowed more providers to be available.

Between 2008 and 2011, the number of abortion providers in Nevada increased by 8 percent, and the number of clinics by 33 percent, the Guttmacher Institute reported.

According to the Institute, as of Oct. 1, 2015, "43 states prohibit abortions, generally except when necessary to protect the woman’s life or health, after a specified point in pregnancy, most often fetal viability." Fetal viability is generally considered to be around 24 weeks, which is the cutoff point for Nevada, New York, Massachusetts, Minnesota, Florida, Pennsylvania, Rhode Island, and South Dakota.

Nevada joins with 20 other states including Mississippi, Wisconsin, Virginia, and New Jersey in requiring that at some point, the procedures must be performed in a hospital. The battle born state requires the surgery be done in a licensed hospital after the 24 week mark for when the procedure endangers the mother’s life, Find Law reports.

All but 12 states require the procedure to be done by a licensed physician. Nevada does have this regulation.

Almost half the states in the U.S. require waiting periods after a woman receives counseling on the procedure. These delays range anywhere from 18 to 72 hours, though the most common waiting period lasts 24 hours. Nevada does not require a waiting period.

Thirty-eight states require some form of involvement from the parents of a minor seeking an abortion, but Nevada is not one of them. The other states without this requirement are California, Connecticut, Hawaii, Maine, Michigan, New Jersey, New Mexico, New York, Oregon, Vermont, and Washington, according to Guttmacher.

The Nevada assembly has been working in 2015 to pass legislation that would require parental notification.
