Maine Abortion Laws and How They Differ From Neighboring States

Maine abortion laws "are more accommodating for women seeking abortions than those of many other states," according to the legal website FindLaw.

Americans United for Life, an anti-abortion organization, ranked Maine at No. 32 on its 2015 Life List, saying the state “provides minimal protection for women seeking abortions.”

"For example, the state’s parental involvement law contains a major loophole, allowing abortion providers to veto a parent’s right to grant or withhold consent. Further, Maine is in the minority of states failing to provide meaningful recognition to protection to unborn victims of violence," AUL said.

Nearby states received similar reviews, with New Hampshire ranking at No. 35, Vermont at 49, Massachusetts at 38, Connecticut at 41, and New York at 44.

NARAL Pro-Choice America gave Maine a grade of A for its choice-related laws.

That organization labeled Republican Gov. Paul LePage as “anti-choice,” the Maine House as “pro-choice,” and the Maine Senate as “mixed-choice.”

Vermont and Connecticut also received A’s for their abortion laws from the pro-choice group. New York got an A- ,New Hampshire got a C+, and Massachusetts got a B-.

A study by the pro-choice Guttmacher Institute ranked Maine No. 39 in a list of state abortion restrictions, The Washington Post reported in 2013. By turn, neighboring New Hampshire ranked No. 45 and Vermont ranked No. 48, echoing the less-restrictive abortion climate of the region.

Maine requires that abortions be performed by licensed physicians. They are prohibited after viability except in cases of life or health endangerment. Public funding for abortions in Maine is limited to cases of rape, incest or life endangerment.
