Maine Abortion Laws and How They Compare Nationally

Maine has more liberal abortion laws than other states around the country, according to FindLaw.

Americans United for Life, a group that opposes abortion, ranks Maine at No. 32 in the nation for its abortion laws, according to the group’s 2015 Life List. It notes that the state has a Freedom of Choice Act that goes into effect if the nation's landmark law making abortion legal, Roe v. Wade, is ever overturned.

“Maine provides minimal protection for women seeking abortions. For example, its parental involvement law contains a major loophole, allowing abortion providers to veto a parent’s right to grant or withhold consent,” AUL said.

In contrast, NARAL Pro-Choice America, which supports abortion rights, gave its highest grade, an A, to Maine. That group labeled Maine’s Republican Gov. Paul LePage as “anti-choice,” the Maine House as “pro-choice” and the Maine Senate as “mixed-choice.”

In 2011, 89 percent of counties nationwide had no abortion clinic, while 81 percent of Maine counties had no clinics, the pro-choice Guttmacher Institute noted.

Abortions must be performed by licensed physicians in the state and are prohibited once the fetus is viable except in cases of life or health endangerment, Guttmacher said. Public funding of abortions in the Maine is limited to cases of endangerment, rape or incest. The state does not require a waiting period before an abortion.

Guttmacher ranked Maine No. 39 in a list of states and their abortion restrictions, according to The Washington Post.
