MURFREESBORO, Tenn. (AP) — A federal lawsuit over a once-planned Bible Park USA theme park in Tennessee has been dismissed.

U.S. District Judge Thomas Wiseman in Nashville threw out the lawsuit Tuesday from the Steve Shelton family, who had an $11 million deal to sell land to BPU Holding LLC.

The Daily News Journal reported that the issue was whether a two-thirds vote of the Rutherford County Commission was required to rezone the property. The vote was 12-9 in favor, but two votes short of the higher standard.

The developer later chose Wilson County as the proposed site but eventually ended the project because of local opposition.
