Daniela Vargas, a 22-year-old Argentinian immigrant, was released Friday on a supervision order after being detained for an expired visa, which was discovered when she spoke out at a protest rally criticizing President Donald Trump’s immigration policies.
Vargas spoke about a Feb. 15 ICE raid in which her father and brother were arrested and later deported. Vargas was in the house during the raid, but was not arrested at the time. She originally came to the United States from Argentina when she was 7 years old, according to NBC News.
Attorneys for Vargas said that she was detained because she spoke against Trump and his policies. She was arrested while a friend was driving her home from the rally. She was in the process of renewing her Deferred Action for Childhood Arrivals, or DACA, Visa, which had expired in November, according to NBC.
The arrest increased fears that other DACA or DREAM (Development, Relief, and Education for Alien Minors) Act immigrants would be targeted for deportation under new immigration rules, The Washington Post reported.
Students and young people may remain in the U.S. under the DREAM Act if they are under 30 and in school or have graduated from high school or college, according to the American Immigration Council.
Vargas will be required to check in with ICE every six months while her case is pending, and she could still be deported, according to NBC.
