Ariz. Initiative Would Prohibit Criminals From Suing

An Arizona ballot initiative would prohibit criminals injured while engaged in, attempting to commit, or fleeing a felony from filing a lawsuit against their victim, according to the Arizona Daily Star.

The changes that would be implemented if Proposition 114 passes do not provide blanket immunity and are only a shield against civil lawsuits.

Charles Heller of the Arizona Citizens Defense League explained, "If someone breaks into a home and gets shot doing it, he cannot collect in a lawsuit against the homeowner unless it's done maliciously."

Many Democrat legislators, including the state’s House Majority Leader Chad Campbell, opposed the initiative, as did the Arizona Trial Lawyers Association.
