Former IRS official Lois Lerner will not be testifying to Congress this week, says her lawyer, adding that he doesn't know why House Oversight Committee Chairman Darrell Issa thought she would be.

Issa told "Fox News Sunday" host Chris Wallace that Lerner had agreed to testify to his committee on Wednesday despite previously asserting her Fifth Amendment right against self-incrimination.

But Lerner's lawyer, William W. Taylor, tells Politico that Issa is wrong.

"As of now, she intends to continue to assert her Fifth Amendment rights,” Politico quote Taylor on Sunday. "I do not know why Issa said what he said."

Issa told Fox that he had been told by Lerner's lawyer she would be offering testimony without a promise of immunity because it is in her best interest.
