New Jersey Abortion Laws and How They Compare Nationally

New Jersey abortion laws are fairly limited when compared nationally. While certain statutes in New Jersey have been intended to limit abortion aggressively, the courts have knocked them down. Pro-life and pro-choice groups both consider New Jersey abortion laws to be permissive.

The pro-life group Americans United for Life believes New Jersey is one of the “worst” states in the nation for protection of life. The group gives New Jersey a ranking of 46 in the list of the “best” states for life laws.

AUL claims, “New Jersey provides no meaningful protection for women considering abortion or for unborn victims of violence.”

The group points to courts that have struck down laws in the state that would require parental consent for a minor to get an abortion. There is no outer limit to the point at which abortion is permissible. The state does not recognize an unborn child as the potential victim of a homicide.

Those who want to protect abortion access, like NARAL Pro-Choice America, believe New Jersey to be a “good” state compared to others in the nation. The organization gives the state an “A-minus" for its legal stance on abortion.

NARAL points to laws — like an attempt to create a post-12-week ban on abortion in the state — as proof that the state is trying to make abortions more difficult to obtain, however, the state courts are at odds with lawmakers passing these measures.

The New Jersey court has ruled that the state constitution provides for a greater access to abortion services than provided by the U.S. Constitution, according to NARAL. The state requires that low-income women are provided state-subsidized abortions and that contraception coverage is provided in medical insurance.

The state courts have also struck down laws that would involve parents in the decision-making process for their children seeking abortions.
