SCOTUS Pick Barrett Won't Say if Trump Can Delay Election

Supreme Court nominee Amy Coney Barrett would not say whether President Donald Trump has the power to delay the election.

During the second day of her confirmation hearings in the Senate Judiciary Committee Tuesday, Barrett was asked whether Trump can push back the Nov. 3 general election.

"Well, Senator, if that question ever came before me, I would need to hear arguments from the litigants and read the briefs and consult with my law clerks and talk to my colleagues and go through the opinion writing process," Barrett told Sen. Dianne Feinstein, D-Calif.

"If I give off-the-cuff answers, then I would be basically a legal pundit. And I don't think we want judges to be legal pundits. I think we want judges to approach cases thoughtfully and with an open mind."

Trump has mentioned the idea of delaying the election because of the coronavirus pandemic. He tweeted in July:

"With Universal Mail-In Voting (not Absentee Voting, which is good), 2020 will be the most INACCURATE & FRAUDULENT Election in history. It will be a great embarrassment to the USA. Delay the Election until people can properly, securely and safely vote???"
