A bill that makes criminal the implementation of Obamacare was passed by South Carolina's Republican-controlled House on Friday.

The Freedom of Health Care Protection Act — approved by a vote of 65-39 — makes "null and void certain unconstitutional laws enacted by the Congress of the United States."

Those laws, the legislation states, take "control over the health insurance industry and mandating that individuals purchase health insurance under threat of penalty."

If the bill were ultimately signed into law by Gov. Nikki Haley, it is unclear what criminal penalties would face those who do implement Obamacare.

But the House's defiant vote would likely face its own federal court challenge since the declaration that the Affordable Health Care Act is unconstitutional defies the U.S. Supreme Court, which last year declared it constitutional.

"This kind of victory occurs when the grassroots across the State come together and coalesce," Chris Lawton of the Greenville Tea Party, told The Greenville Post. “I could not be prouder.”

Haley said earlier this year said the Palmetto State will not implement Obamacare.

"Connecticut expanded early under Obamacare and just reported a $190 million Medicaid deficit," the governor said in her State of the State address.

"California just raised taxes in part to cover their Medicaid deficit and yet needs $350 million more to pay for Obamacare next year. That’s not us. That’s not South Carolina."
