Sex Video Clears 2 Men of Rape, Gets Their Accuser Prison Time

A sex video made on a cellphone two years before has cleared two California men of rape and now has the purported rape victim facing prison time for a beating one of the alleged rapers took from her boyfriend.

A jury in Sacramento convicted Jasmine Levanna Kurre, 27, of felony assault likely to produce great bodily injury and felony battery on July 5 in connection with the beating of one of the men who she had accused of raping her, reported the Sacramento Bee. Jurors, though, acquitted her for misdemeanor filing of a false police report and of another felony count of robbing the beating victim of his cellphone.

The men, who were not identified by the Sacramento Bee, said they had sex with Kurre after going out with her and another female friend at a club in suburban Sacramento on Feb. 15, 2011. One of the men started recording the sexual romp that showed Kurre laughing and voluntarily participating, authorities told the Sacramento Bee.

One of the men told police Kurre returned to his place to retrieve items she had left behind and while outside of his apartment, two men jumped him and beat him for several minutes, the newspaper reported. The man told authorities one of the men claimed to be a boyfriend and accused him and his friend of rape.

The man contacted police after the beating and after Kurre told authorities the man and his friend raped her. That's when the men showed police the video.

"This is great stuff," Citrus Heights Police detective Ron Pfleger told the man who shot the video, according to a transcript of an interview that occurred five days after the beating. "This is exactly what you guys are hoping for."

Authorities said Kurre's rape story would have held a lot more weight had it been not for the video.

The case is the second noteworthy incident in California where a false rape accusation resulted in reverse results for the accuser. In June, the Long Beach Unified School District won a $2.6 million default judgment against Wanetta Gibson, who falsely accused now NFL player Brian Banks of rape and had taken a judgment from the school district, reported the Long Beach Press-Telegram.
