A Nutella-induced fight in a California Costco store over the weekend landed a 78-year-old grandfather in the hospital and leveled charges of elder abuse on a 24-year-old man, which could result in an 11-year sentence.

The kerfuffle began on Sunday when Sahak Sahakian approached a Nutella waffle sample cart in the warehouse store in Burbank, California, and began to reach for one, according to the Los Angeles Times. Just as he tried to pick up a sample of the hazelnut spread, Derrick Gharabighi seized all of the available samples, startling Sahakian.

“He takes two, three of them, left one,” Sahakian told CBS Los Angeles. “I want to take that one and he catch my hand. I say, ‘What are you doing? Let me eat this one.’ He hit me and the blood started.”

Sahakian began bleeding and became dizzy, suffering a one-inch cut and swelling above his left eye, according to the Times. After he received treatment at a nearby hospital, he was released later the same day.

“It's a shame that it had to come to this over a Nutella sample,” said Burbank Police Department Sgt. Claudio Losacco, according to Fox News. “It's a tragic situation where someone in their 70s, almost 80 years old, is faced with something like this.”

Gharabighi was taken into custody after the Nutella fiasco and jailed in a Burbank prison on $50,000 bail in his latest clash with the law, according to Fox News. Two weeks earlier, as well as in April, June, and December, Gharabighi had been arrested, and he has been convicted for possession of illegal drugs and for their sale and petty theft. In 2012 and 2013, Gharabighi received trespassing convictions and, in July, he received felony charges for spousal or cohabitant abuse, as well as spousal battery.

If Gharabighi is convicted on charges of elder abuse for the violent results of his excessive Nutella craving, he is eligible for a maximum sentence of 11 years, according to CBS Los Angeles.
