NFL Weighs Liability Waivers for Fans in the Stands

As sports begin playing this summer without fans, the NFL is weighing sending liability waivers to fans seeking to attend games this fall, The Athletic reported.

The waivers would shield teams and the league from being sued if fans were to contract COVID-19 and claim it happened at the game.

"It is probably something you do electronically, just trying to figure out the operational challenges associated with waivers," a source told The Athletic. "Just have to work out how best to do that."

The NFL has already cut its preseason schedule from four games down to two, effectively removing the first and fourth exhibition games in August, before the September start to the season.

The waiver proposal is going to be sent to teams next week as part of the coronavirus protocols to be put in place by the NFL this season, per the report.

Clubs might have latitude to decided how many fans, if any, it wants to have in the stadium for games.

The New York Giants and Jets, who play their games in East Rutherford, New Jersey, have already told fans holding season ticket licenses they can get a refund or a credit for the 2020 season.

Among the proposals for screening fans coming to games were turnstile temperature checks – which could be worked around with over the counter medicine – or more likely an electronic questionnaire, per the report.

Liability waivers can be contested if willful or gross negligence is shown, the website for New York-based law firm Zalman, Schnurman & Miner claimed, per the New York Post.
