Judge Nap: Mueller Dropped Ball on Trump Indictment

Special counsel Robert Mueller dropped the ball in deciding not to indict President Donald Trump, Judge Andrew Napolitano said Thursday.

"Here's where I think Mueller dropped the ball," Napolitano said on his latest episode of Fox News' "Judge Napolitano's Chambers." "Mueller says the president can't be prosecuted because presidents can't be prosecuted. Well, if presidents can't be prosecuted, then they're above the law. And we know, the basic principle of American jurisprudence is no one is above the law."

Attorney General William Barr in March released a brief summary showed Mueller did not conclude Trump colluded with the Russians to win the 2016 election. Regarding obstruction of justice, Mueller said it was not clear if Trump did or did not commit that crime. Barr and Deputy Attorney General Rod Rosenstein decided against pursuing charges.

Mueller, though, last week said he did not clear Trump and indicated it was up to Congress to decide whether he should be impeached.

Napolitano said nobody "can get away with that kind of lawbreaking," but said the president's legal woes are now behind him.

"Impeachment is not legal, it's political," Napolitano explained. "But it cannot succeed without broad bipartisan support behind it. I don't think that support is there today."
