Report: Insurers Ignore Obamacare Rules, Deny Coverage

Insurance companies are either denying or ignoring coverage for some Obamacare-mandated services, including free or low-cost birth control, a withering report finds.

The 22-page report by the National Women's Law Center studied plans in 15 states, and found at least one plan in each that violates the healthcare law by illegally collecting co-payments or imposing coverage limitations on certain services.

For example, 14 plans in seven states offer maternity coverage that doesn't comply with the Affordable Care Act, while more than 50 plans in 13 states offer preventive services coverage that falls short.

Shockingly, the researchers found widespread violations of Obamacare's requirement for plans to cover all types of Food and Drug Administration-approved birth control, with some insurers continuing to charge women out-of-pocket for birth control and limiting coverage to only certain methods.

"Insurance companies are breaking the law by denying women coverage to which they are entitled," said Gretchen Borchelt, vice president for health at the organization, the Washington Examiner reports.

"Insurance companies must comply with the law, and regulators should do a better job enforcing it. Otherwise women will again be at the mercy of insurers whose previous discriminatory practices drove the need for reform in the first place."

The Washington Examiner notes Obamacare's preventative services and birth control coverage are features the Obama administration has used as big selling points for the law.

"We will continue to provide guidance to help ensure that women have access to recommended preventive benefits and will explore whether additional measures are necessary," Department of Health and Human Services spokeswoman Katie Hill told The Hill in an email.

But the head of America's Health Insurance Plans, an insurers' group, said the study presented a "distorted picture of reality."

"To use highly selective anecdotes to draw sweeping conclusions about consumers' coverage does nothing to improve the quality, accessibility, or affordability of healthcare for individuals and families," said the group's president and CEO, Karen Ignagni, The Hill reports.
