Tom DeLay's Attorneys Ask for New Trial

Wednesday, 09 February 2011 08:11 PM EST

HOUSTON (AP) — Convicted former U.S. House Majority Leader Tom DeLay's attorneys are asking for a new trial.

They filed a motion Wednesday saying the former Houston-area congressman deserves a new trial in part because of juror misconduct. They allege some jurors made up their minds before deliberating or didn't follow the judge's instructions.

They also cite misapplication of the state's election code and faulty juror instructions.

Prosecutors say there the motion contains no new legal grounds that merit a new trial.

A judge in Austin last month sentenced DeLay to three years in prison for his role in a scheme to illegally funnel corporate money to Texas candidates in 2002. Jurors had convicted DeLay on charges of money laundering and conspiracy to commit money laundering.

He remains free on bond pending appeal.
