The lawyer for seven members of a CNBC television crew arrested after allegedly attempting to sneak a fake bomb through security at Newark Liberty International Airport is optimistic they'll go free.

Attorney Harold Ruvoldt told NJ Advance Media that after the group's first court appearance on Friday, he is confident the facts would show that no crime had been committed and no grand jury would indict on the evidence.

The Essex County Prosecutor's Office has charged the crew with second-degree counts of conspiracy, creating a false public alarm, and interfering with transportation — punishable by up to five years behind bars.

The Transportation Security Administration alleges that some of the crew "attempted to intentionally carry through the security checkpoint an item in a carry-on bag that had all of the makings of an improvised explosive device. At the same time, others in the group covertly filmed the encounter."

Essex County Supervising Assistant Prosecutor Anthony Higgins said Friday he is recommending the case to the county's special prosecution unit.
