Sen. Smith: Anti-Bloomberg Law Will Save Small Businesses

Mississippi’s proposed law to ban limits on portion sizes and requirements to post calorie counts — the so-called “anti-Bloomberg’’ bill — will save countless numbers of small businesses from going belly up, State Sen. Tony Smith says.

“It is not the role of municipalities to tell small businesses how they should sell or what they should sell,’’ Smith, who represents the Magnolia State’s District 47, told Newsmax TV’s “The Steve Malzberg Show.’’

This week, on the same day a judge blocked Mayor Michael Bloomberg’s ban of the sale of super-sized sodas, senators in Mississippi approved 50-1 a bill that would stop similar efforts.

Gov. Phil Bryant is now reviewing the bill that would prevent all counties and districts from capping size portions on food and drink and stop the banning of food based on its nutritional content.

Smith who authored the legislation said America has become “a nanny nation’’ trying to pass too many unnecessary regulations.

“The question you have to ask is, when will it stop?’’ he said. “We are very pleased we stood up … What you are risking is the livelihood of these business owners.

Smith, who owns a popular eatery called Stonewall’s Barbecue in Picayune, introduced the legislation after being approached by concerned members of the Mississippi Hospitality and Restaurant Association.
