A lawyer in New York Gov. Andrew Cuomo's administration — shot by a stray bullet last week — died after being taken off life support, USA Today reports.

Carey Gabey, 43, had been in critical condition since he was shot in the head Sept. 7 as gang-related gunfire erupted on a Brooklyn street where he was walking, USA Today reports.

There have been no arrests in the case.

Gov. Cuomo expressed his condolences on Twitter:

In a statement Wednesday, Gabay’s family said he was officially declared brain dead late Tuesday night, USA Today reports.
