Steve Jobs Deposition Video to Bring Him to Life in Courtroom

A Steve Jobs' deposition filmed just before his death in 2011 will play in a California courtroom as a key piece of evidence in an anti-trust case starting Tuesday.

According to The New York Times, Jobs' testimony from beyond the grave could help or hinder the company he left behind as the court investigates a complaint filed in 2005 accusing Apple of intentionally locking people into the iPod ecosystem.

At specific issue is Apple's FairPlay DRM software that rendered songs bought on iTunes unable to be played on anything but an iPod. In total, the potential damages accumulated between 2006 and 2009 amount to $350 million — a small sliver of Apple's most recent quarterly profit of $8.5 billion.

In speaking about Jobs' deposition, emails, and other items entered as evidence, Michael A. Carrier, a professor at Rutgers School of Law, told the Times that Job was a visionary "genius" when it came to technology, "But it went along with a really healthy ego and perhaps the lack of an antitrust filter — thinking about how these words would appear years later tossed up on the screen in front of a jury."

In an email from 2003, Jobs made it clear he wasn't happy with the launch of an iTunes competitor.

"We need to make sure that when Music Match launches their download music store they cannot use iPod. Is this going to be an issue?" he wrote.

In other dealings with competitors, he appears to make thinly veiled litigation threats.

"My advice is to take a look at our patent portfolio before you make a final decision here," he wrote to Palm after it rejected Apple's no-poaching agreement.

In addition to hearing evidence from Jobs, Apple's top executives like Philip Schiller and Eddy Cue will also likely take the stand.
