The U.S. Senate rejected a House-passed bill to ban abortions from being performed after 20 weeks of pregnancy on Monday.

The legislation would have posed strict penalties of up to five years imprisonment to those performing an abortion after the stipulated time frame, although women seeking abortions would not be penalized and neither would the bill impose restrictions in cases of rape, incest or when considered necessary, ABC News reported.

The Pain-Capable Unborn Children Protection Act failed to get the 60 necessary votes to advance, instead receiving a closely divided vote of 51 to 46.

The bill was authored by Sen. Lindsey Graham and passed by the House in October, a move that Republicans in the Senate hoped would put Democrats on record with the controversial vote.

Speaking on the senate floor on Monday afternoon, Senate Majority Leader Mitch McConnell said: “This afternoon, every one of us will go on record on the issue,” per USA Today. “I hope that our Democratic colleagues will not obstruct the Senate from taking up this bill.”

However, The Washington Post reported only three Democrats – Sens. Robert P. Casey Jr. of Pennsylvania, Joe Donnelly of Indiana and Joe Manchin III of West Virginia — voted to advance the measure.

Two Republicans — Sens. Susan Collins of Maine and Lisa Murkowski of Alaska — voted against the bill.

Graham said that, although the vote had been lost, “we won heart and minds.”

He noted that the arguments made in favor of the bill were “powerful and compelling,” while the arguments against “rang hollow.”

Democrats said Republicans were wasting time on a “politically-motivated, partisan bill,” according to ABC News.
