Prince Harry has won a settlement from a photo agency for aerial photos of his home with wife Meghan that the British royals said “seriously undermined” their safety and privacy.

Splash News and Picture Agency was taken to court by the Duke and Duchess of Sussex after their photos were distributed and published.

The agency agreed to settle the case and apologized “for the distress we have caused."

The photos were taken from a helicopter hired to fly over the royals private home in Oxfordshire, central England.

Splash chartered the helicopter in January to hover over the home and take photos of the dining room, bedroom and living room, according to Sky News. The images were published in The Times newspaper and appeared on numerous news sites.

Harry's lawyer said the couple had specifically chosen the Cotsworld home because of the privacy it offered and said that the invasion of privacy was considered a threat to them.

"The syndication and publication of the photographs very seriously undermined the safety and security of the Duke and the home to the extent that they are no longer able to live at the property," the lawyer said in a court statement. "The property had been chosen by the Duke for himself and his wife given the high level of privacy it afforded, given its position in a secluded area surrounded by private farmland away from any areas to which photographers have access."

Splash removed the photos and agreed to not make them publicly available again, The Telegraph noted. In a statement, the news agency explained that the situation "represents an error of judgement" and noted it had taken measures to ensure a similar incident does not occur.
