A Popeyes worker has been charged with a felony of aggravated assault after attacking a woman seeking a refund from the restaurant after she was allegedly double billed.
The incident occurred last week in the parking lot outside the restaurant in Tennessee and the employee, Deriance Ra’Shaiel Hughes, was arrested Friday.
The unnamed 55-year-old woman who suffered the assault remains in the hospital after sustaining a broken leg, a shattered elbow and six broken ribs, according to New York Post.
The altercation took place when she returned to the restaurant after being double charged for her meal of chicken tenders, apple pies, corn, and biscuits, The Tennessean reported.
The woman's lawyer Rocky McElhaney explained that when his client arrived at the branch, she was "treated with hostility and anger from the manager." McElhaney added that "there were words back and forth."
Staff claimed that the woman, who is white, used a racial slur that aggravated Hughes.
Video footage taken by a witness in the parking lot shows the woman exiting the restaurant with several people in tow. One person is seen punching her, and then Hughes picks her up and slams her into the concrete ground while onlookers cheer him on. A passerby approaches the crowd and appears to check on the woman. The attackers then retreat back into the restaurant.
McElhaney has denied that his client used any racial slur.
"My client was called 'an ugly broke-down cracker,'" he said, adding that the woman was sad and angry of how events unfolded that night. "Nobody deserves to be treated like that."
