Former NFL wide receiver Plaxico Burress was indicted last week on charges he failed to pay taxes and is also accused of a failed electronic funds transfer, which is the equivalent of passing a bad check.

Burress, 37, of Totowa, New Jersey, was the first to be charged on the new statute that makes failed EFTs equivalent to bad checks, a press release from the Mercer County Prosecutor’s Office said. The bill was signed by Gov. Chris Christie in September 2014, closing a gap between how paper checks and electronic transfers were treated.

Burress filed his 2013 state income tax return in October 2014, submitting an EFT to pay his $47,903 tax bill, the release said. The EFT did not go through and, when letters were sent trying to collect the funds owed, Burress failed to respond.

Burress, who played for the Pittsburgh Steelers, the New York Giants, and the New York Jets, faces up to 10 years in prison for the two counts of failure to pay state taxes, TMZ reported.

A Burress representative told TMZ Sports that he did not intentionally try to avoid his tax payment.

“Prosecutors are clearly trying to take advantage of a guy who's been in the news negatively and trying to make an example out of him," the rep told TMZ.

The rep said rumors that Burress is out of money are untrue, and that he has fired his accounting firm and plans to pay the debt.

Burress has had other issues with the law in the past few years. The former athlete shot himself in the thigh accidentally and ended up pleading guilty to violating a New York weapons laws. He spent 20 months in prison.

In addition, he’s been sued frequently over unpaid bills, and The Associated Press found in 2009 that “he had been sued an average of once a year since 2000 over debts, damages to cars and tax nonpayment.”
