The parents of a NYC helicopter crash victim are suing the pilot and his company for negligence after their son and four other people were killed over the weekend, ABC News reported. Only pilot Richard Vance survived.

The incident took place on Sunday when the heliptor crashed into New York's East River, turned over and sank in about 50 feet of frigid water.

Vance was able to free himself from the wreck, CNN reported. Emergency workers had to cut out the five passengers, who were tightly harnessed into the open-door helicopter.

The dead were identified as Daniel Thompson, Tristian Hill, Carla Vallejos-Blanco, Brian McDaniel, and Trevor Cadigan, per ABC News.

Cadigan‘s parents taking legal action against Vance, the helicopter company and other operators.

The suit claims the deaths could have been avoidable if the aircraft had been correctly maintained and had not tipped over, People magazine reported.

The legal document says escape was made impossible because of the way the passengers were harnessed to the helicopter and accuses Vance of failing to brief the passengers on proper safety and for being “careless in failing to take reasonable steps to extricate the passengers” after securing his own release, according to ABC news.

“Imagine for a second hanging upside down in frigid water, tightly harnessed with a release that is inaccessible because the access to them is only in the back,” said family lawyer, Gary C. Robb, per People.

“I call that a death trap…It is a horrible position to be in and this family wants that practice to stop. It should never happen.”

Vance reportedly told investigators that the incident may have been caused by a bag that struck the emergency fuel shutoff button on the helicopter, The Guardian reported.
