Man Ordered to Pay $65K in Child Support for Kid Who Isn't His

A Texas man must pay $65,000 in child support for a kid who isn't his.

Gabriel Cornejo, a Houston resident, is challenging the courts after he was ordered to pay child support in 2003 for a kid he's only met once, according to ABC 7 New York.

The 45-year-old, who took a DNA test to prove he's not the father, says he's guilty of nothing in this situation.

"I never thought in my whole life I would have to defend myself of something that I am innocent of," he said, the station reported.

Cornejo already has quite the level of responsibility as a father of three who is also raising his two nephews.

Cornejo first learned of the hefty child support payment last year when a deputy came to his home and gave him documents that claimed he was believed to be the father of a teenaged girl, ABC 7 reported.

The girl is the daughter of Cornejo's ex-girlfriend, but he and the ex reportedly haven't been together for 16 years.

According to The Houston Chronicle, Cornejo's DNA results proved he's not the father. However, those DNA results were not taken into consideration because the test was done after the 2003 court order.

Cornejo's lawyer Cheryl Coleman told the newspaper her client has to pay the child support because of Texas' family code, chapter 161, which states that "even if you're not the biological father, you still owe child support that accrued before the DNA test proves you're not the father."

Coleman defended her client's disdain for the court order given some problems she found with the records that were served to him in 2002.

"I've researched the records and found that there is an issue with the service where they served him back in 2002," Coleman said, the Chronicle reported. "There are some anomalies with how this case was handled by the attorney general's office. He was never served with those documents in 2002 when the actual paternity petition was filed against him."

Despite the fact that Cornejo isn't the girl's biological father, he did still agree to see her.

"She's a wonderful girl," he said, according to ABC 7. "Very smart. A lot going on for herself."
