Loud Music Trial Begins Again to Determine First-Degree Murder Charge

A retrial for the first-degree murder charges against Michael Dunn, in what has become known as the "loud music trial," began Monday in Florida.

In November 2012, Dunn fired at an SUV because the teenagers inside of it were playing music too loudly. In a first trial that ended in February, Dunn, 47, was found guilty of three counts of second-degree attempted murder and one count of firing into a vehicle.

But the jury was hung on whether Dunn was guilty of first-degree murder in the death of 17-year-old Jordan Davis.

Dunn already will serve 60 years in prison, a cumulative sentence for the four charges, CNN said.

The question to be decided is whether Dunn’s actions would be considered premeditated, making it first-degree murder. Dunn has said that he fired in self-defense and that he saw something come out of the window of the car and thought it was a weapon.

The defense has made much of the fact that Dunn and his girlfriend, Rhonda Rouer, didn’t call 911 after they left the scene of the shooting, CNN said. Instead they went to a bed and breakfast and didn’t do anything about the shooting until they saw information on the news that weekend.

"They had cell phones, but they didn't call 911. He didn't drive to a police substation," CNN quoted Assistant State Attorney John Guy from the first trial. "That defendant put his head on his hotel pillow and went to sleep."

"Emotions are high. Many want to comment that this trial doesn't mean as much, as Dunn is expected to face a minimum mandatory of 60 years in prison. That's hurtful," John Phillips, family lawyer for Davis' parents, Lucy McBath and Ron Davis, told Florida Today. "Dunn wasn't just an attempted murderer that night. He killed a teenager. A son. A hope for a bright future for Ron and Lucy, full of a wedding, grandchildren and fulfilled dreams.”
