Lauren Spierer Family Suit Against 3 Who Last Saw Her Goes Federal

Lauren Spierer Family Suit Against 3 Who Last Saw Her Goes Federal

By    |   Friday, 28 June 2013 10:23 AM EDT

Her family's lawsuit filed against the last three men to see missing Indiana University student Lauren Spierer before her 2011 disappearance has been bumped up to federal court

Spierer, 21, reportedly went out drinking with friends on June 3, 2011, in Bloomington, Ind., and was never seen again. Her parents, Rob and Charlene Spierer, filed suit against Corey Rossman, Jason Rosenbaum, and Michael Beth in May, claiming they were the last three to see the Greenburgh, N.Y., native before her disappearance. The case is still unsolved and no body was ever found.

The Spierers maintain that the three men's negligent actions, or inactions, may have contributed to their daughter's vanishing and presumed death. The lawsuit alleges that Rossman, Rosenbaum, and Beth — who were all with Spierer at various times that night — were aware that she was "extremely intoxicated to the point of incapacitation," yet didn't do enough to make sure she made it home safely.

"Spierer's abandonment in an intoxicated and disoriented state in the early morning hours of June 3, 2011, in an area known for criminal acts contributed to her disappearance, and presumed injuries and death," the lawsuit states, according to ABC News.

"Any parent in search of information about a missing child would use every resource available to them," Rob and Charlene Spierer said in a statement. "Therefore, we intend to use the rights afforded by the civil justice system to obtain answers to questions that have gone unanswered for too long. We fully expect that those with relevant information will cooperate with this process."

The case is now headed to federal court because the parties involved are from different states, WISHTV.com reported.

The Spierers are seeking unspecified damages.
