Cyclist Lance Armstrong's son, Luke, has been charged in the sexual assault of a 16-year-old girl, according to an arrest affidavit obtained by KVUE on Wednesday.

The 21-year-old was arrested Tuesday for the incident, which allegedly took place nearly three years ago. Luke Armstrong's attorney addressed the claims Wednesday in a statement.  

"A complete review of the facts will confirm what has been alleged absolutely did not occur and a proper and thorough legal process will exonerate Luke," he said. "What occurred three years ago in high school was not a crime and was not a sexual assault. It was a consensual relationship then and continued consensually between two young adults, with both ultimately going their separate ways. These charges should never have been filed, certainly not three years later. However, thankfully, the Texas court system works and will establish Luke’s innocence."

According to the arrest affidavit, the alleged sexual assault took place in June 2018. The woman claims to have gone to a party, where she drank to the point of intoxication, then called Luke to take her home. She did not recall the ride, but said she remembered waking up at a home listed in the report as Luke's residence on the 1700 block of Windsor Road. She went to sleep and told police she later woke up to find Luke kissing her. She said she was unable to stop him from raping her and lost consciousness during the alleged assault. Luke and another male then reportedly drove her home. 

The woman came forth with the allegations two years later, and an investigation was launched on Nov. 17, 2020. Police interviewed several people with whom the victim said she had shared details of the incident. Their accounts show that she was intoxicated beyond consent and showed notable behavioral changes after the party. 

The woman's mother also noted behavioral changes and recalled her daughter telling her that Luke had done something to her that she didn't want. Police also spoke to a person who rode with the woman and Luke the night of the alleged assault, who said the woman did not appear to be overly drunk at the time. He said that, when they returned to Luke's residence, the two went inside but he did not know what they did. He claimed the woman later called him to say Luke had raped her. 

On Dec. 8, 2020, police assisted the woman in making a call to Luke during which he admitted to having sex with her. He said he had been drinking too, and remembered asking if they were going to have sex that night. He claimed the woman walked to the bed herself after he asked. 

Luke Armstrong has been charged with sexual assault of a child, a second-degree felony. His bond was set to $75,000. His attorney said Luke had been granted and released on a personal recognizance bond, which means he did not need to post bail, on Tuesday, according to Cycling News.
