Juan Manuel Montes, who claims to be the first deported "Dreamer" under the Trump administration, is being held for illegal re-entry into the U.S., Fox News reported.

The 23-year-old was arrested late Monday night for illegally attempting to enter the U.S. and was taken into custody near Calexico, California.

Montes was caught and booked into the Imperial County Jail after attempting to run away from agents that had spotted him just north of a border fence, Fox News reported. He could face up to two years in prison on felony charges.

The Deferred Action for Childhood Arrivals (DACA) program provided protection against deportation to about 700,000 undocumented immigrants brought into the country as children, also known as Dreamers, CNN noted.

In September Trump announced he was putting an end to new DACA applications and renewal applications.

Montes was brought into the U.S. when he was 9 years old and is said to have a cognitive disability possibly stemming from a childhood brain injury, the New York Daily News noted.

His lawyers claim that Montes was wrongly expelled from the country in February, but the administration has argued that he left on his own accord, cancelling his protection status under the program.

Montes attempted to re-enter the U.S. not long after the night that he claimed he was deported.

According to USA Today, he was scaling a border wall but was caught and deported by Border Patrol agents.

"Border Patrol Agents will always stop, detain, and arrest anyone making an illegal entry into the country irrespective of their immigration or citizenship status," the agency said, according to Fox News.
