Supreme Court Justice Ruth Bader Ginsburg on Monday called Colin Kaepernick's and other sports stars' national anthem protests both “dumb” and “disrespectful,” although she acknowledged the protesters had the right to do so.

In an interview with Yahoo's Katie Couric, Ginsburg stated she would not arrest protesters for refusing to stand for the national anthem at sporting events, but she does not approve of their actions or those who burn the flag, either.

"I think it's dumb and disrespectful. ... I think it’s a terrible thing to do," Ginsburg said of the protests, "but I wouldn’t lock a person up for doing it. I would point out how ridiculous it seems to me to do such an act."

When pressed about protesters’ rights to do so, Ginsburg said, “If they want to be stupid, there’s no law that should be preventative. If they want to be arrogant, there’s no law that prevents them from that. What I would do is strongly take issue with the point of view they are expressing when they do that.”

Kaepernick has stated his refusal to stand up for the flag stems from not wanting to show pride in a country that “oppresses black people and people of color,” he told NFL Media. His protest is intended to show solidarity with the Black Lives Matter movement against recent police shootings of unarmed black men.

The 49ers backup quarterback began his protests at the preseason games in August and has been joined by several other 49ers players and by other professional, college, and even high school athletes from various sports since that time.

Although he has drawn widespread criticism since beginning the protest, Kaepernick has clarified that he does respect the military and just wants to show his criticism of American oppression and the need for change.
