Dumpster Boy's Brother, 5-Year-Old, Was Alive When Thrown Into River

Dumpster boy's brother, 5-year-old Josue Ramirez-Marinero, was alive when his 25-year-old half brother threw him into a river last week, officials said.

The 25-year-old Nebraska man, Roberto Martinez-Marinero, is accused of killing his mother, leaving his 11-month-old half brother in a Dumpster, and tossing the other boy into the Elkhorn River, the Omaha World-Herald reported. Remains believed to be Josue's were found Monday after four days of searching.

Martinez-Marinero could face the death penalty, according to the World-Herald.

Eleven-month-old Angel Ramirez-Marinero was found Wednesday when a passer-by heard a noise in a Dumpster in La Vista and rescued him. The body of the boys’ mother, Jesus Ismenia Marinero, was found in a ditch. She was reportedly being hit with a baseball bat and stabbed multiple times.

“These are the kind of cases that never leave you,” Douglas County Attorney Don Kleine said, according to the World-Herald. “Words don’t adequately describe the sadness and gravity and senselessness when something like this happens to a child.”

Martinez-Marinero surrendered to police Thursday and faces two counts of first-degree murder, kidnapping, and weapons charges, The Associated Press reported. His girlfriend, 24-year-old Gabriela Guevara, also faces charges of being an accessory.

A judge denied bond for Martinez-Marinero and set bail for Guevara at $1 million, WOWT-TV reported. Guevara’s attorney says she maintains her innocence and will seek a bond reduction because she has two young children.

Authories believe the young boys were present when their mother was murdered and that Martinez-Marinero acted as he did to eliminate the witnesses to the murder.

Martinez-Marinero and his mom had reportedly been arguing about money in the weeks leading up to the crimes, the World-Herald said.

The boys’ babysitter, Teresa Rivera-Avelar, sobbed uncontrollably upon learning that Josue’s body had been found.

“I spent all of my time with them. They (Josue and Angel) grew up at my house,” she said, according to the World-Herald. “I loved Josue as my own child, and Ismenia was my best friend.”
