Cop Charged for Kick: White Officer Seen Using Force on Black Suspect

A white Delaware police officer has been charged with assault after a dashcam video released Thursday showed him kicking a black suspect in the face as the man surrendered to officers.

Dover Police Cpl. Thomas Webster IV, 41, has been indicted by a grand jury for second-degree assault, the New York Daily News reported.

He was arrested Monday and is on unpaid leave from his police department position, the News said.

The video shows Webster and another officer arresting Lateef Dickerson as a possible suspect in a gas station assault in 2013. In the video, as Dickerson drops to the ground, Webster kicks him in the face, breaking his jaw and knocking him unconscious, the News noted.

Although the video shows the initial calls indicating one of the suspects in the gas station incident had a gun, the News said a gun was not found on Dickerson, who was charged with assault, theft, and resisting arrest. The charges were later dropped.

Webster was put on paid leave in 2013 while an internal investigation of the incident was made, and he returned to duty in June 2014, the News said.

The American Civil Liberties Union sued to have the video released to the public.

“We believe that the video demonstrates the need for large-scale reform of the Dover Police Department, specifically improvements to their use of force and internal affairs practices, and supervision of their officers," Kathleen MacRae, executive director of the ACLU of Delaware, told the News.

According to the Delaware News Journal, the first grand jury to examine the case failed to indict. But a new attorney general asked for a review after looking at the case, and it was that grand jury that found cause for further proceedings against Webster.

“Webster attorney James Liguori in a statement said the second grand jury saw the same evidence as the first grand jury,” the News Journal reported. “He said what's changed is that Dickerson is suing Webster, the city and the police department in federal court.”
