Student With Cerebral Palsy Taped by Teacher, Lawsuit Alleges

The family of a student with cerebral palsy has filed a lawsuit alleging their daughter's mouth was taped shut during school hours among other abusive and neglectful actions during her time at the school.

Doreen Smith is suing High Point School, an Ann Arbor school for special needs students, related to numerous complaints she made against the school's teachers and aides for how they treated her daughter Rosa, now 27, The Washington Post reported.

The allegations include teachers taping Rosa Smith's mouth, locking her in the bathroom, and pouring hot coffee on her, causing burns. Her teacher, the school principal, and two teacher's aides are named in the suit along with the school district, covering incidents going as far back as 2004, the Post reported.

Attorney Jonathan Marko told reporters at a news conference that Smith's complaints were ignored or downplayed for years, and that teachers and staff often blamed Rosa Smith for the incidents, including spilling coffee on herself and gouging herself with an unknown object, the Post reported. Smith alleges that her daughter was not capable of injuring herself because of her severe disability.

Smith eventually removed her daughter from the school after getting no response to her complaints, Fox News reported.

"These weren't accidents, and there was abuse going on," Marko said, Fox reported.

The school said that no incidents were reported to the principal or other officials until a year after they occurred. School district spokesperson Emma Jackson said that the principal and teacher no longer work for the school district, but were not fired because of the allegations, the Post reported.
