Supreme Court Justice Anthony Kennedy is back on retirement watch following a National Public Radio article on Justice Neil Gorsuch that gave Kennedy’s possible departure a push.

The article published over the weekend said it's unlikely Kennedy who turns 81 on July 23 will remain on the court for the full four years of President Donald Trump's term.

“While he long ago hired his law clerks for the coming term, he has not done so for the following term (beginning October 2018), and has let applicants for those positions know he is considering retirement," according to NPR

The report rekindled rumors of Kennedy's imminent departure, which recently were doused when the 2016-2017 Supreme Court term concluded without any official announcement of his retirement.

Kennedy has been on the Supreme Court since 1988. He was nominated by President Ronald Reagan and has been the swing vote on many of the court's 5-4 decisions.

There is concern among liberals who know that Kennedy stepping down gives Trump an opportunity to nominate someone more conservative, noted New York Magazine.

Trump wants a conservative majority on the court to drive his own political agenda and shape rulings on issues such as religious rights, gun control and abortion rights.

The nomination earlier this year of Gorsuch had already caused conflict among liberal groups who called for his rejection and conservative groups who praised him, according to Reuters.

Kennedy graduated from Harvard University in 1961. He worked at a law firm in California from 1961 to 1976 and, from 1975 to 1988, served as a judge on the U.S. Court of Appeals while also lecturing at the University of the Pacific.
