Angelina Jolie Loses Ruling in Bitter Divorce Case

Angelina Jolie's request to have the judge removed from her and Brad Pitt's divorce and custody case has been denied. Judge John W. Ouderkirk will continue to oversee proceedings, according to legal documents obtained Tuesday by Entertainment Weekly.

In August it emerged that Jolie requested in a filing made in Los Angeles Superior Court that the judge be disqualified from the case over claims that he had business relationships with Pitt's attorney, Anne C. Kiley. The "Maleficent" star claimed that the judge "failed to disclose the cases that demonstrated the current, ongoing, repeat-customer relationship between the judge and Respondent's counsel."

The newly obtained legal documents reveal that Jolie "failed to meet her burden of proof to show legal grounds exist" for the disqualification of Ouderkirk, according to Entertainment Weekly. "This determination is not an appealable order and may be reviewed only by a petition for writ of mandate filed in the appropriate court of appeal within 10 days of notice to the parties of the decision and may only be challenged by the parties to the disqualification proceedings," per the outlet.

Last week, in separate legal documents obtained by Entertainment Weekly, Ouderkirk denied Jolie's allegations and said he would remain impartial throughout the case.

"I will continue to consider accepting other cases as other additional cases may arise from time to time while the Jolie/Pitt case is still pending," he said. "Such other cases might involve party, lawyer‚ law firm and/or witnesses involved in the Jolie/Pitt matter."

Responding to Jolie's request to remove Ouderkirk from the case, Pitt accused his ex-wife of using the demand to delay the ruling for the settlement and custody arrangements of their six children, whom he claimed were being hurt the most by the stall tactics.

Jolie's lawyer, Samantha Bley DeJean, hit back with an accusation that Pitt's filing was an attempt to sway Ouderkirk's decision.

"Any delay in these proceedings is due to their zealous attempt to create an unrecognized special exception for their client's benefit," DeJean said.
