Adam Carolla Sued by Friend Donny Misraje Over Memoir Photos

Adam Carolla, the comedian-actor formerly of "The Man Show," is being sued for the second time this year by "a very close friend of . . . over 30 years," according to a lawsuit filed May 30 in U.S. District Court in Central California.

The most recent case involves the use of several photographs in Carolla's 2012 memoir "Not Taco Bell Material."

In the suit, Carolla's friend Donny Misraje – a Hollywood producer and editor – alleged the images belonged to him and that the comedian as well as his publisher, Crown Publishing, and Carolla did not have "permission, consent or license to [use them]."

"Plaintiff believes that he has suffered or is likely to suffer damages and will continue to suffer serious and substantial damages resulting from Defendants' copyright infringement, including irreparable injury for which there is no adequate remedy at law," the lawsuit states.

Through the suit, Misraje is requesting compensation for the alleged infringement and punitive damages, as well as that the court stops Carolla and Crown Publishing from further alleged infringement of the materials, TheWrap.com reports.

Misraje is also reportedly requesting that the remaining copies of "Not Taco Bell Material" be destroyed.

A spokesperson for Carolla and Crown Publishing did not respond to media inquiries for comment earlier this week.

The initial lawsuit occurred in January when Misraje sued Carolla for after having allegedly broken a partnership agreement in connection with the development of the comedian's podcast.

Misraje claimed that after playing a major role in the launch of the comedian's podcast, he was pushed out of an arranged partnership, which he said constituted 30 percent of the podcast company.

In the January lawsuit, Misraje claims to have quit a $231,000 a year job as a producer and editor to devote himself to the podcast before Carolla reportedly fired him.

In addition to his comedic work on Comedy Central, Carolla is a former "Celebrity Apprentice" contestant and a Fox News contributor, appearing on a weekly basis on The O'Reilly Factor.

According to the lawsuit, "The Adam Carolla Show" podcast had nearly 60 million downloads by March 2011, two years after it started, making it at the time the world's most downloaded podcast.
