On Monday, Jan. 30, the Council on American-Islamic Relations (CAIR) will hold a news conference at its Capitol Hill headquarters in Washington, D.C., to announce the filing of a federal lawsuit challenging the so-called "Muslim ban" executive order signed by President Donald Trump.
The lawsuit, to be filed in the U.S. District Court – Eastern District of Virginia will challenge the constitutionality of the order because CAIR sees Trump’s decision as an attempt to ban people of the Islamic faith from entering the United States.
CAIR announced that "Our First Amendment is under attack. We, as attorneys, are foot soldiers of the American Constitution and took an oath to protect all from being targeted by the government because of their faith," said Attorney Shereef Akeel, who is also co-counsel on the lawsuit.
First. Since when does CAIR care about the U.S. Constitution, or freedom of religion for that matter?
CAIR shamelessly supports applying Shariah law which is utterly incompatible with the basic foundations of the U.S. Constitution, and is decidedly against any freedom of religion other than Islam.
Second. If President Trump’s decision was discriminatory against Muslims based solely on the parameter of religion, it would have applied the ban equally across all Muslim countries (and all Muslims who live in any other part of the world as well).
It is clear that, the decision to ban refugees coming from particular places is based on national security concerns. The geographies specified are proven breeding grounds for terrorists. It would be irresponsible and dangerous not to carefully vet people seeking to enter the U.S. from such places. Terrorism is a clear and present danger. If security it is not a legitimate concern, why are wheelchair-bound American grandmothers subjected to security checks when the travel domestically by air?
Third. The decision to give priority to the Christian refugees can only be seen as a form of "positive discrimination" (which is to say, affirmative action), which has been applied to help some minorities in the U.S. and in other parts of the world. There is no doubt that Christian minorities have suffered the most from the barbarism of ISIS and other Islamic organizations.
To help the reader understand the suffering of Christians under Islamic systems, I will not bother to detail the beatings of hundreds of Christians for their faith.
Nor will I discuss the wholesale burning of churches.
I will instead just pass along a story of ISIS militants who fed a desperate old mum a meal of "meat and rice" before telling her that the meal she had just enjoyed was the mutilated remains of her own son.
In short, CAIR’s attempt to challenge President Trump’s decision to halt the influx of unvetted refugees and others from nations that represent a clear and present danger to the security of the U.S. until a rational assessment process can be put in place is baseless and unfounded, even setting aside the fact that they have no standing in the case.
And to challenge it on the grounds of unconstitutional infringement of freedom of religion is disingenuous in the extreme.
