The filing by prosecutors will include an admission that a handful of the documents could have been perceived by McVeigh's attorneys as helpful to his case during his trial and sentencing, Justice Department sources said.

FBI officials announced six days before McVeigh's scheduled May 16 execution that they had discovered 3,135 pages of files related to the case that had not been turned over to defense attorneys or prosecutors. The execution is scheduled for June 11.

McVeigh's attorneys announced Monday that two more lawyers with experience in the case will join the legal team analyzing the newly disclosed FBI records in the investigation.

Richard Burr and Chris Tritico, both Houston lawyers who represented McVeigh during his Denver trial in 1997, will be joining Rob Nigh, of Tulsa, and Nathan Chambers, of Denver, on the McVeigh legal defense team.
