State Supreme Court to Get Revote Suit

A lower court judge, Circuit Judge Labarga, had ruled he did not have the power to order a revote. The 4th District Court of Appeals scheduled a hearing for Monday, but before it began decided to kick the matter up to the high court without hearing it.

"The court decided to grant certification of this case as a question of great public importance requiring immediate resolution to the Florida Supreme court," said the order as read by court clerk Glen Rubin.

Attorneys for the plaintiffs said they were optimistic that the high court would hear the case. They have requested a new vote in the presidential election in Palm Beach County because voters said the ballots were so confusing some of them voted for Reform Party candidate Pat Buchanan when they thought they were voting for Vice President Al Gore.
